The consequences of an OWI/DUI conviction

At Vandervoort, Christ & Fisher, P.C., in Michigan, we know that the drunk driving laws are very tough in this state. If you have been charged with operating while intoxicated, an OWI conviction could result in a number of adverse consequences, such as a jail sentence, probation, your driver’s license being suspended, and fines and/or court costs.

If you are a commercial driver, you could lose your job if your license is suspended. Likewise, if you are a doctor, nurse, attorney, pilot or other professional person, an OWI conviction could jeopardize your professional license.

Definition of operating while intoxicated

Under section 257.625 of the Michigan Vehicle Code, operating while intoxicated means the following three things:

  1. You were driving under the influence of alcohol, any other intoxicating substance, and/or a controlled substance at the time you were pulled over.
  2. Your alcohol content was 0.08 grams or higher per 210 liters of breath, 100 milliliters of blood, or 67 milliliters of urine at the time you were pulled over.
  3. Your alcohol content was 0.17 grams or higher per the same three measurements at the time you were pulled over.

Beginning on October 1 of next year, the alcohol content necessary for an OWI charge increases to 0.10 grams per 210 liters of breath, 100 milliliters of blood, or 67 milliliters of urine.

If you are under the age of 21, however, Michigan has even stricter requirements. You will be charged with OWI if your alcohol content was 0.02 grams or more per the same three measurements at the time you were pulled over.

OWI conviction penalties

If you are convicted of OWI, you are guilty of a misdemeanor and could face any or all of the following:

  • Imprisonment ranging from 93 to 180 days
  • 360 hours of community service
  • A fine ranging from $100 to $700

If you caused an accident resulting in someone’s injury and you are convicted of this form of OWI, you are guilty of a felony and could face imprisonment for up to five years and a fine ranging between $1,000 and $5,000.
